Terms of Service

These Terms of Service govern the use of the SIA Ankravs Inc. application WinMessages and the Meta app VivienneBusiness (the Service).

By using the Service, you confirm that you have read these terms and agree to them.

2. Service Description

WinMessages is a business messaging solution that allows authorized users to connect their WhatsApp Business account to our system using the WhatsApp Business Platform / WhatsApp Cloud API.

The Service may include:

• receiving and processing incoming WhatsApp messages;
• storing messages in the system;
• displaying messages to authorized users;
• preparing and sending replies;
• processing technical logs and system events for security and maintenance purposes.

3. Right to Use the Service

The Service may be used only by:

• lawful and authorized users;
• businesses or their authorized representatives who have received the required access rights;
• users who use the Service in accordance with applicable laws and Meta / WhatsApp terms.

The user is responsible for ensuring that their WhatsApp Business account and communication content are lawful.

4. Prohibited Use

When using the Service, it is prohibited to:

• violate laws or the rights of third parties;
• send illegal, misleading, offensive, or fraudulent content;
• use the Service for unauthorized bulk messaging or spam;
• attempt to bypass security mechanisms or gain unauthorized access to the system;
• use the Service in a way that violates Meta or WhatsApp terms.

5. User Responsibility

The user is responsible for:

• the security of their username and password;
• not disclosing access credentials to third parties;
• all activity carried out through their account;
• ensuring that information entered into the system is accurate and up to date.

If the user detects possible unauthorized access, they must contact us immediately by email at info@ankravs.lv.

6. Availability and Changes

We aim to provide uninterrupted operation of the Service, but we do not guarantee that the Service will always be available without interruptions or errors.

We have the right to:

• perform maintenance work;
• fix errors;
• change, supplement, or improve the Service;
• temporarily or permanently restrict certain features when necessary for security, maintenance, or compliance with legal requirements.

7. Third-Party Services

The Service operates in connection with third-party platforms, including Meta and WhatsApp. We are not responsible for the operation, availability, changes, or restrictions of those third-party services.

The user must also comply with the applicable third-party terms and requirements.

By using the Service, the user acknowledges that communication data may be processed, stored, and protected in accordance with the operational needs of the Service, applicable laws, and our Privacy Policy.

9. Intellectual Property

All rights to the Service, its structure, design, content, software, and related materials, unless stated otherwise, belong to SIA Ankravs Inc. or the respective rights holders.

Without our prior written permission, it is not permitted to:

• copy, distribute, or modify any part of the Service;
• use the Service commercially for a purpose other than its intended purpose;
• attempt to decrypt, decompile, or otherwise analyze the Service software, except where expressly permitted by law.

10. Limitation of Liability

To the extent permitted by law, SIA Ankravs Inc. is not liable for:

• indirect or incidental losses;
• loss of data caused by third-party services, technical disruptions, or unauthorized access;
• losses arising from the user's improper or unauthorized use of the Service;
• interruptions in the operation of Meta, WhatsApp, or other third-party systems.

The user uses the Service at their own risk to the extent permitted by applicable law.

11. Suspension or Termination of the Service

We may restrict, suspend, or terminate access to the Service if:

• the user violates these terms;
• there is suspicion of unauthorized or unsafe use;
• it is necessary for security, legal, or technical reasons.

12. Changes to These Terms

We may update these Terms of Service from time to time. If the terms are changed, the new effective date will be shown on this page.

By continuing to use the Service after changes are published, the user agrees to the updated terms.

13. Governing Law

These Terms of Service are governed by the laws of the Republic of Latvia, to the extent not limited by applicable international or mandatory legal requirements.
